DQS takes the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with applicable data protection laws as well as the European Union (General Data Protection Regulation 2016/679). With this policy of "personal data protection and liability" we inform you about how, to what extent and for what purposes we process personal data when using the website

1 Collection, processing and use of personal data on request

Use of our website is generally possible without providing personal data. You are not required to visit this website or provide any personal information. If you do not provide us with personal information, you may not be able to use certain features of this website. Otherwise, it will have no consequences for you. If personal information (such as name, address or email addresses) is collected on our site, it is held on a voluntary basis, except as expressly provided below. This data will not be provided to third parties without your express consent. We would like to point out that data transmission over the Internet (for example, communication via e-mail) can have security risks. Full data protection against third party access is not possible.
If the processing of your personal data is based on your consent, you have the right to withdraw your consent at any time, with the result that the processing of your personal data will be inadmissible for the future. However, this does not affect the lawfulness of the processing performed on the basis of consent until cancellation.

2 Data processing to enable the use of websites
When you visit our website, we collect the necessary information to enable you to use it. This includes your IP address and information about the beginning, end and subject of use of the website, as well as any identifying information (eg your login details when logging in to the secure area). This data is used to provide and design the service as required. They are always deleted when they are no longer needed and there are no storage obligations. See section 5 for processing pseudonymous user profiles for web analytics.

3. Consent to cookies and web analysis
When you visit our website, the so-called "Cookie banner" in which we ask you for your consent to the setting of cookies for website optimization (see section 4) and for web analytics (see section 5). If you agree, we proceed in more detail in the following two sections. You'll also find information on how you can revoke your consent at any time and prevent the setting of cookies or site analysis.

4. Cookies
If you visit our website and give your consent (see section 3), it is possible that information in the form of a cookie is stored on your computer. Cookies are small text files that are sent from a web server to your browser and stored on your computer's hard drive. This will let you know when you visit the site again. In this way, we can guarantee better functionality of the website and the implementation of e.g. web analytics (see section 5). Most browsers are set to accept cookies automatically. 5a Web Analytics (Google Analytics)
If you visit our website and agree (see section 3), we use Google Analytics, a web analytics service by Google LLC, 1600 Amphitheater Parkway, Mountain View, CA 94043, USA (Google). Google Analytics uses cookies (see section 4) to analyze your use of the website. Information about the use of this website is usually transmitted to a Google server in the USA and stored there. However, Google will shorten your IP address in the Member States of the European Union or in other signatories to the Agreement on the European Economic Area in advance and will therefore make it anonymous. Only in exceptional cases will the full IP address be sent to a Google server in the US and truncated there. On behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators.

5b MyDQS; myCERT (Registering)
Under the domain DQS Group (DQS GmbH, DQS Holding GmbH, DQS CFS GmbH, DQS Medizinprodukte GmbH) as joint controllers according to Article 26 GDPR offer our customers the possibility to register for a password protected area (hereinafter referred to as MyDQS) where certifications, order confirmations, reports and other relevant documents can be provided by us and accessed by you.

If you request from your customer advisor to register for MyDQS, the advisor will create a login for you, based on your relevant contact-data (name, e-mail address) and your organization’s DQS-file number. Your name is required in order to know, who the request comes from. We need your e-mail address to send you an email with a link for your initial registration. To complete the registration process, you will need to provide additional mandatory information about your company. If you have voluntarily given us your telephone number to be contacted by phone, this number will also be transferred to the account. After your first registration, you have to set a password of your own choice. Together with your e-mail address, this enables access to your account.

If permissions are provided, you can add and activate additional members from within your organization. In order to create a login, you will have to provide

  • First and last name
  • Working position
  • E-mail address
  • Professional contact details

of the person you’d like to register. The newly created user will receive an activation link with which the login can be activated as described above. The link is valid for 24 hours. If the account is not activated by the member of your organization, the details provided by you will be deleted automatically after 48 hours. The organization’s admin can delete additional accounts at any time within the portal itself.

The processing of data is carried out at your request and is required in accordance with Article 6 Para. 1 Subpar. 1 lit. b GDPR for the purposes mentioned above for the performance of a contract we have with you and pre-contractual measures as well as based on legitimate interests of DQS Group to jointly offer its customers additional services, based on Article 6 Para. 1 Subpar. 1 lit. f GDPR. If you wish to deactivate your organization’s account as a whole, you can request deletion from DQS by e-mail at any time. The personal data processed by us within the context of MyDQS will then automatically be deleted after all contractual matters have been settled, unless you have consented to additional storage (in particular company details and user accounts) in accordance with Article 6 Para. 1 Subpar. 1 lit. a GDPR or legal storage obligations prevent deletion.

You can, in principle, exercise your data subject rights towards any member of the DQS group. Internally responsible, however, is first and foremost DQS GmbH

6. Legal basis for processing
The legal basis of the processing depends on the purpose of the data processing. We collect the data as described in point 5, data for pseudonymized user profiles to improve the website under the applicable media data protection law.

7. Transfer to third parties and in countries outside the EU
Your personal data will only be sent to third parties if it is legally permitted or if you have consented. For example, we may transfer data to other DQS Group companies if necessary to respond to a request you have asked us to do. We will provide your data to state authorities only within the framework of legal obligations or as a result of an official or court decision. The transfer to non-EU recipients takes place only if it is guaranteed that the data recipient guarantees an adequate level of data protection and that there are no other interests that should be protected from data transfer. If you have any questions in this regard, please contact our data protection officer (see section 11).

8. Deleting
Data collected by Google Analytics in the form of pseudonymous user profiles (Section 5) will be deleted no later than 38 months after the last entry in the relevant user profile. In all other respects, we will delete your personal data as soon as they are no longer needed for the purposes of monitoring the collection and processing and if there are no legal obligations regarding their further storage.

9. Data security
DQS has taken the necessary technical and organizational measures to protect the personal data you provide against loss, destruction, manipulation and unauthorized access. Our employees and all persons involved in the processing of data are obliged to comply with data protection laws and to treat personal data confidentially. Our employees are trained accordingly. Internal and external tests ensure compliance with all relevant data protection processes in DQS.

Your rights regarding personal data
The Data Protection Act grants you and guarantees a number of rights relating to your data (the so-called rights of data subjects). In general, it is the right to request information about your personal data that we have stored, as well as to correct, delete or restrict the processing of this data and to object to its processing. Whether and to what extent these rights exist in individual cases and what conditions apply depends on the law (until 25 May 2018 from the national data protection law, from 25 May 2018 also from the basic EU data protection regulation). The EU Basic Data Protection Regulation also grants you the right to transfer data. If you have consented to the processing of your personal data, you can cancel it at any time with effect for the future. They also have the right to appeal to the competent data protection supervisory authority. However, if you have any questions or complaints regarding data protection in DQS, we recommend that you first contact our Data Protection Officer (see section 12).

11. No automatic decision
Unless it is absolutely necessary for the conclusion of a contract or permitted by law (as in the case of age verification), we do not use your personal data for automatic individual decisions.

13. Amendment of Privacy Policy
New legal requirements, business decisions, or technical developments may require changes to our privacy policy. The privacy policy will then be adjusted accordingly. You can always find the latest version on our website.

In the case of indirect or direct links to external websites (so-called links) which do not fall within DQS's area of responsibility, the obligation to commit would only take effect if DQS is aware of the content and if it would be technically possible and appropriate to use it as illegal content. We hereby expressly declare that at the time of the transfer, no illegal content was recognizable on the pages to be linked. We have no influence on the current and future design, content or origin of the linked sites. We expressly dissociate ourselves from the content of all linked sites that have been changed after submission, as well as from any illegal or immoral content on the Internet.
